THE PELOSI VERSION OF HR 3200
When I first read HR 3200 in its entirety several months ago I was appalled at the blatant disregard in the bill of the basic tenets of our Constitutional form of government. However, I underestimated what is actually being done to us. The newest version of HR 3200 that has been labeled the Pelosi Bill is the original bill on steroids. It is the most “in your face” challenge to the American people as a whole that has ever occurred. While Nancy Pelosi, Harry Reid, and President Obama continue to reassure the American people about what the bill will do, the proof is there in black and white.
We are about to lose our Republic because this latest version of HR 3200 takes away our freedom to make our own choices in areas such as what type of insurance we want to have, (if any), how much we are willing and able to pay for insurance, which doctors we choose to take care of us, and what type of treatment we can choose based on our doctor’s recommendations. All of these decisions will now be made by federal bureaucrats in Washington who don’t know us and don’t care about us as individuals.
These decisions will be made by the Secretary of Health and Human Services based on the recommendations of an advisory panel chaired by the Surgeon General, who is appointed by the President, and made up of nine members who are not Federal employees or officers that are also appointed by the President. There are nine more members who are not Federal employees or officers who are appointed by the Comptroller General of the United States and there will also be up to eight more members who are Federal employees or officers and are appointed by Obama. How’s that for a stacked deck? That’s like having a task force in the Justice Department dedicated to fighting organized crime made up of a majority of members of the Russian Mafia.
By the way, if you are wondering how many medical professionals are required to be members of this advisory panel that will decide on the type of healthcare you can get, the answer is none. The previous version of the bill required at least one, but apparently it was decided by Pelosi et.al. that this was one too many. Section 223 of the Bill on page 111 lays it all out if you care to read it.
In addition, everything I mentioned in my first article on HR 3200 is still there although additional attempts have been made to hide them. For example, there will be rationing of health care, programs for seniors will be drastically cut, and there will be programs available for illegal aliens since all they have to show is that they are “residents” of the United States. There will also be instant access available to your medical and financial records under the provisions of Section 1173A on page 76.
There are also numerous new taxes being imposed to pay for all of this and of course there are the fines that are imposed on people who don’t get health either health insurance or government approved health insurance. (These are incorrectly called taxes in the bill because if they were labeled as fines people would be entitled to protection under the due process clause of the 5th Amendment to the Constitution. There is absolutely nothing in the Constitution in Article 1, Section 9 that grants the Congress the right to strip the states and individuals of the United States of their rights and powers in this area. There are no Supreme Court decisions that authorize it either under the commerce clause or the General Welfare Clause of that article. Yet, when asked about the Constitutionality of the law Nancy Pelosi’s response was “Are you Serious?” In other words, we are all idiots and only the new aristocracy made up of the all the President’s appointees and the members of Congress is capable of knowing what I best for us.
The bottom line is that this alleged health care bill and a number of other bills in Congress are designed to establish a form of government that is even worse than the one the Constitution was designed to protect us from. I, for one, am getting fed up. This bill and others pending in Congress, as well as regulations being proposed by the “Czars”, will strip us of our Constitutional rights in a number of areas. We will no longer be “citizens” of the United States, but will be “subjects” of another nation entirely. It is time that the members of Congress are told in emphatic terms that if they won’t abide by their oath of office to “support the Constitution” we see no reason for them to keep their jobs.
Tell them now! We are free citizens of a Republic and will never stand for being anything less! I personally hereby re-affirm the Declaration of Independence from Tyranny made by my forefathers and for which members of my family have fought for in every war from the American Revolution to today. I can say it best by taking the same oath that was taken by the signers of the Declaration in 1776.
“And for the support of this Declaration, with a firm reliance on the protection of divine Providence, we mutually pledge to each other our lives, our fortunes, and our sacred Honor.”

As a retired Registered Nurse, this so-called health bill is chilling, to say the least. I've said, since the subject was first brought up during the campaign, that it would lead to rationing of health care, starting with senior citizens. Who will be next, to be denied care? Children born with birth defects that will require extensive care and/or surgeries? Oh, silly me, they will be aborted, after an ultrasound show that they won't be "perfect babies." I KNOW that millions of Americans DO NOT want any money going to pay for elective abortions, yet if this bill is passed, as it currently exists, this will be the result. We must continue to let our voices be heard, be in contact with our members of Congress, and continue to band together to stand up for what's right, abiding by the Constitution.
This bill is despicable and should not be passed.

There is no middle ground with Obama. He is either loved as the Liberal savior of all men or hated. I honestly believe he has split this country so deeply we may never recover from his attacks on our Constitution and personal freedoms.
I ony hope the upcoming elections will help to stiffle his ability to continue at his current pace.
Mike, like you I believe this is about defending the principles of America's founding. It is also about honoring all those who have sacrificed everything so that we might live free, and to fail to resist now is to insult their memory. I've been following your blog from weeks and have anxiously awaited your review of the "Peolosi Bill". You haven't disappointed. I share your pledge in re-affirming the Constitution. I admire your endurance in reading the 1990 pages on our behalf. So few people have read it. Have you been contacted by the media for comment?
All of the recently closed doors in DC shows monumental arrogance. 3200 is pelosi's last stand. Too many penalties, fines, taxes, restrictions on freedom to have to present it transparently. She is pushing for a vote by Thursday of this week. Thx for taking the time to read this very dangerous bill and give us your respected opinion in a concise and understandable manner. Just too many traps hidden in 1,900 pages.
Mike--you are indeed a fine Pariotic American and I wholeheartedly join you. Lord Monckton of Great Brition, an advisor to the former Prime Minister, Margrett Thacher, advises that on December 17, 2009, just a few weeks from now, President Obama will go the Copenhagen to sign the Copenhagen Climate Treaty along with all of the other World Governments. Among other things, the Treaty states that the developed countries, i,e., United States will pay the underdeveloped countries 5% of our Gross Domestic Product annually and forevermore, as retribution for our polluting the world. Oh yes, this large amount on top of the trillions we are already in debt due to the Obama Administration. But what is even more chilling is that the Treaty binds us to a One-World Communist Government and our Nation becomes a Communist Nation under the One-World Government, and our Constitution goes AWAY! (according to Lord Monckton who says for us to fight it all the way). The Treaty will be binding if and when 2/3rds of the U.S. Senate approves it. Therefore if we are to do something we must notify all of our Senators to disapprove the Copenhagan Climate Treaty....and we must be ready to take back our Republic by voting all Socialists, Marcists, and Communists out of office. There is estimated to be 70-80 ot more card carrying Socialists in the House of Representatives alone, and more who think as them. How many are in the Senate I do not know, but it's probably not too hard to project...just look up how each one voted on stupidly proposed, Anti-American Bills (like Cap & Trade and Healthcare for ALL Americans) and you can bet your life you found them.
Do you know there is even a proposed H.R. Bill to make it illegal for you to grow a garden in your own back yard or be imprisoned for 10 years and fined $100,000. Something must be organized and done quickly to fight the madness and win (per Lord Monckton), and per every red blooded patriotic American who values their freedoms as set forth in our Constitution, Bill of Rights and Declaration of Independence, and their God Almighty. On Monday, October 12th, I was extremely
privileged to spend time with Lord Christopher Monckton and his wife, Lady
Juliet Monckton. You never know the unexpected ways in which God will
bless you. In passing the evening with this exceptional couple, I
was doubly blessed not only by the pleasure of their excellent company but
also by their clear insight into matters of great import--matters that
have the potential utterly to destroy the sovereignty of the United
States. This entry recounts what Lord and Lady Monckton shared with myself
and others over the course of a pre-lecture dinner conversation. His
Lordship also worked a portion of this information into his talk at the
University of Wisconsin-Madison later that evening.
Lord Monckton is one of the few people who has thorough
familiarity with a recently completed draft of the treaty President Obama
will sign in Copenhagen in just a matter of weeks (DECEMBER 17, 2009). He does not mince words
about what he has found in the course of his reading of the document.
The treaty is not just a foot in the door
for one-world government. It IS communist, one-world
government. And because of the high regard in which our
Constitution holds foreign treaties, this document, if ratified by
Congress, would supercede the Constitution.
The treaty will, of course, be signed under
the banner of coming together internationally to "save the environment"
through the reduction of carbon emissions. Except, oh dear, cat's out
of the bag...global warming is a giant lie.
While Lord Monckton has become one of the
most visible and vocal apologists for this fact, he is hardly alone. MANY
credible scientists with solidly conducted research to back them up, have
revealed the meme of human-caused climate change as a complete farce.
With wealth comes a cleaner environment.
When nations have money and a sense of civic responsibility--such as that
present in this nation--they tend to clean up after themelves. Even if
global warming, or "climate change," were a
reality, the United States and other Western nations could never, in
honesty, be called the world's most egregious polluters (I'm sure we all
have an awareness of who would be on that list). Except,
that's exactly how this treaty labels us. And in so
labeling, not only does it attempt to rob us of our sovereignty, it also
wants to drain us of our wealth via a huge reparations scam. As the "big
polluters," we will be forced to pay a substantial portion of our
GDP to the Third World for "ruining the environment." If we do
not pony up, we will be subject to even heavier penalties under
international law. As I understand it from Lord Monckton, the treaty
implements its chains very cleverly and on many levels. It will bind us
more closely, for example, to other organizations of dubious reputation
and merit such as the UN, the IMF, and the World Bank. We will be
surrounded and pinned.
We have all watched redistribution of
wealth occurring on an international scale for some time now. TARP
involved the transfer of billions of dollars to other nations. But this
treaty would RATIONALIZE,
INSTITUTIONALIZE, and ACCELERATE the
redistribution.
To be abundantly clear, the American people
will have no voice or say in this matter--or likely many others--once the
treaty is signed. Lord Monckton expressed very frankly that the words
democracy, electorate, and voting are conspicuously absent from the treaty
language. This document is intended to make America powerless and
poor.
THE COPENHAGEN TREATY MUST NOT BE
RATIFIED!!!
The Copenhagen conference is scheduled for
early December. We have only a few short weeks to educate our fellow
Americans and make a very loud noise to our wily legislators so that they
do not end up enslaving us through a foolish or underhanded vote against
U.S. sovereignty.

Also, arm yourself with facts on the matter
of climate change. Lord Monckton is, of course, an excellent source. Many
organizations, such as the Committee for a Constructive Tomorrow (CFACT)
and Americans for Prosperity (AFP) frequently offer free copies of
Monckton's 2007 video, Apocalypse? No! The video
doesn't contain all the most recent damning science, but it's an excellent
start. His Lordship is very engaging. You won't be bored.

As we are reading, let us also be passing
this information on to everyone else we can lay hands on...including
well-meaning but misguided greenies. Not all of them are hard-core
idealogues. If those who are simply misguided could see where this will
take us--the crushing cost to our freedom and our finances--they might
begin to take a different view of what they have been told is best for
them--indeed, what is "best" for all of us.
Mike, your original article on the health care fiasco was emailed to me by a friend. I verified it (given the junk that floats around on the internet), then printed and read your comments at our Sept. 12, 2009, TEA Party in NW MN.
I just finished printing your additional comments about this bill and will work them into our TEA Party Round Table discussion for the public on Nov. 8, 2009.
I would like to suggest that those of us who are concerned about what is going on in our country need to support the candidates who can bring our country back from the far left in the 2010 elections. We need to send money to candidates regardless of the state they are in, so candidates like Joe Wilson ("You lie!} can defeat the Democratic candidate who runs in opposition to them. That is the best and quickest way to defeat those who cannot remember they swore to protect and defend our Constitution in their oath of office. I think all of the Representatives are up for election in 2010, and about 2/3 of the Senate, but I'm not sure about that.
Regarding the Glenn Beck interview with Lord Christopher Monckton, I thought Lord M. said that this "treaty" is written in such a way that it is not truly a treaty and therefore DOES NOT REQUIRE RATIFICATION! It only requires Obama's signature to be in effect. (I hope I misunderstood.) This is something that definitely needs legal scrutiny and interpretation!!
I'll be happy to stand alongside anyone who will fight this administration's twisted "change" for our country. Here I am, in my 63rd year of life, getting actively involved in politics because I am AFRAID of the direction this Administration is taking our country. It is PAST TIME we took back our country, and get back to the beliefs of our founding fathers as written in the Constitution.
I think the new bills aims are a lot more nefarious than even you point out, and I personally feel it is a way to get the country to make the turn left towards socialism. If we think back historically many sudden changes in government were caused by economic and other problems either conceived or taken advantage of by people either in power or trying to get into power, Hitler is a prime example. Hitler took advantage of several factors, economic and well as a feeling of despondency by his people from the restrictions that were put in their country by the defeating powers of WWI. The left, or progressives, you take your pick what you call them, are talking advantage of the economic climate as well as are producing other "emergency" issues as a kind of slight of hand in their move to radically transform the U.S. into something similar to Russia Light. God help us all.

I am an analytical project report writer and while working on something over three years ago I concluded that the very best possible case scenario I could devise was that Americans face The Greater Depression, which will last at least a dozen years. I write and edit professionaly, so I use words very precisely. The very BEST awaiting us is a lengthy period during which the most security to be found will be through the ability to grow and raise your own food and having an extensive stock of goods to barter.
Carl mentioned the Food "Safety" Act (which I have already asked Mr. Connoly to scrutinize.) It will not JUST outlaw heirloom seeds (for the benefit of Rep Rosa DeLauro's husband's interests with Monsanto.) but will restrict us to dangerous genetically-modified seeds. The crops grown from those do NOT produce seed that will reproduce.
Far worse than that, the bill will destroy the last 2.1 million small farmers and ranchers. It will be a CRIME to possess and transport raw milk in your vehicle! I will not be able to sell what my goats and cows give or even to give it away. The new rules will make it so expensive and so difficult that anyone who doesn't qualify now as Agribiz will not be able to become liicensed as a dairy. It would cost at least a hundred thousand dollars to construct the four buildings (to their plans and specifications) just to milk four or five goats and a couple of cows! Without an all-stainless "commercial" kitchen in another separate screened, vented concrete building I could not even make butter to sell. It appears I would not be able to sell even eggs, which come in their own sterile containers.
Far worse than that, even, it will be a CRIME to process meat at home for your own use. Never mind the false premise--that the bill will prevent food-borne illnesses, all of which originate in heavily-regulated plants and factories. You won't be able to kill a rooster for Sunday dinner. Our local slaughterhouse read the proposal and shut down both their butcher shop and the processing plant! It will be open only during deer season. Reedfields, which has been in business forever in the area, will be reduced to the frozen food locker portion of their business.
The bill demands that every last one of my animals be RFID chipped--and provides enormous fines for not reporting changes in the numbers within 24 hours, from sale, death, theft, whatever. The rancher will have to go to the considerable expense AND inventory the stock daily. Agribiz only has to chip ONE bird out of many thousands in a house.
This isn't about food "safety." It is about government control of the food supply and the pay-off to Agribiz for their financial support. The chips would be discarded very early in the processing of animals, and would not begin to identify the origin of every hamburger and package of steak in case of Mad Cow disease. (And the alternative is worse, in terms of book-keeping. Imagine being told that you had to keep the wrapper from MacDonald's for five days in case you got ill!) Using the Census as an excuse the government is attaching GPS coordinates to every address. This is not a rumor; I and several others have talked to the "census workers." With a functioning RFID chip and a GPS coordinate, how hard would it be to implement Executive Order 11921 (a time bomb that has in place for more than two decades) so that my "excess" stock and provisions could be confiscated by a SWAT team or any other bunch of Corcoran-booted thugs sent to do it? "Excess," of course, would be in the eye of those taking what is mine. The contents of my pantry, diesel fuel, cattle, the family silver, a child's bicycle, the EO is written to include EVERYTHING.
Do not think this is of no importance because you don't own a French Alpine goat and a few hens. It does, particularly if the big boys collapse under increasing taxes and higher costs of labor, fuel, power, feed, and machinery. My BEST prediction requires that you have the ability to grow at least part of your own food.
ALL of the enabling legislation Hitler used has been incorporated in the cynically-named PATRIOT Acts and other recent legislation. Naomi Wolfe's slim volume "The End of America" explains that quite clearly.
The other two alternatives are outright dictatorship, with or without the third revolutionary war. ALL that the president (Bush could have done it) has to do is declare a national emergency and he has the power to dismiss Congress for six months. Under the newer laws HOMELAND SECURITY will be in complete charge and NO ONE has any redress or can even question any actions HS implements.
There is another very dangerous bill under which the Feds claim ALL the water in the US, including that which runs down your drain spouts. (No, I am not joking.) Many of you probably have only a vague idea of the investment, work, and constraints of raising crops or animals. The government blunders along changing rules as they go along, but if the government chooses to drain my two small man-made lakes, the livestock will die. By what right does the government insist it can come put a meter on the well I paid for, drawing water which is mine by deeded right, and pumped by electricity I pay for, and charge me for it? Already the government has ample power to destroy businesses by "regulating" water. I visited for several days on Lake Buchanan a week ago. A great B&B we visited is dying, as are the trade of fishing guides, cruises, the local grocery store, and other hotels...because the Colorado River Authority lowered the level of the lake thirty feet! As a pay-off to friends in Austin. Only one private launching facility can still put a boat in the water. The other docks are thirty to a hundred feet away from the water's edge. Lakefront property took an enormous dive over and above the collapse of the housing bubble.
An enormous aluminum plant in the Northwest has been forced out of business...because the Greens insist upon flushing water needed for hydroelectric purposes uselessly in a futile attempt to help the sacred salmon, who do not benefit. Most of the crops in Southern CA died for lack of water this year. Worse, some ten years ago CA began buying electricity from Washington State, which raised our bills there enormously. Federal regulators got into the mess recently and decreed that the needs of the aluminum plant were nonessential (they weren't) and--in something straight out of Atlas Shrugged--allocated the power elsewhere. Now you not only have to have large amounts of money to be certain you have power and water, you had better have government pull, too.
The Statists are closing the last loopholes by making it impossible to get a little land in the country, get at least a dairy goat and a feeder calf, and plant a garden. Of what use will it be to raise cattle, goats, pigs, chickens, and sheep if you cannot eat what you grow and can only sell them to Agribiz...at the price they offer?
I hope all of you have at least three months' food stored for your family--don't let even the neighbors know you have it--and ample stocks of tea, coffee, hot cocoa, rice, flour, beans, alcohol, tobacco, and ammunition for trade goods. Buy seeds anyway; if the drug culture can raise marijuana under lights in closets, we can grow carrots that way.
Plan ahead; have everything ready to go so that if riots break out you can be on the road and outside the city limits as quickly as possible. Have a destination in mind and a rendezvous point agreed on, since you will probably have to go in separate vehicles.
It is almost certainly impossible for you to leave your jobs and set up even a small home in the country. I started with land, a shabby old house, an enormous old barn, and a well. You won't believe me if I tell you what it cost to accumulate a couple of dozen Black Dexter cows and a bull, the goat herd, the chickens, farm machinery, and so forth, but this is a real case of the Vanderbilt quotation: "If you have to ask what it costs, you can't afford it."
If you have relatives in the country, see if you can store food with them, and buy an old motor home or travel trailer for your "suitcase" and a roof over your head. Perhaps you and friends could band together. Bare minimum over what I suggested is a dairy goat ($250 to $400) and a small flock of chickens. (Chickens lay an egg every 26 hours. They have to be protected against hawks, skunks, raccoons, possums, wild dogs, and so forth.) A good goat will give about a gallon of milk a day for many months. You can't make butter out of it. A Jersey or Gurnsey still costs a thousand dollars and gives 2 or 3 gallons a day, more than most groups need.
At least THINK about what you will do "if." What if we go through another hundred cities in flames from Watts-type riots? Another Katrina? A suitcase nuke...there are a lot of unpleasant possibilities which could lead to rationing, confiscation, and desperate people doing desperate things.
There are 80,000 US troops being trained to deal with "civil unreast" down South. One of the phrases they are being taught is "Civil disobedience WILL NOT BE TOLERATED."
The details are not in yet on Majar Hassan (dead, conveniently) and the two others who went on a shooting spree at Ft. Hood today. One moral is that even trained soldiers are helpless when they are unarmed. Another is that there HAS been a deliberate attempt to infiltrate the military with Muslims, as was...rumored. Google will confirm that there are serious problems with gangs in the armed forces.

I am with you. Please keep me on your e-mail list to keep us informed as to how to fight this. My Senators and Representatives are conservative Republicans and have done what they can to stop this bill, and I continue to write and call them almost weekly. Now that this has passed the House - what can we do more than keep the pressure on? Can we begin to raise the constitutional questions - I am already supporting impeachment of Obama for his treasonist actions!!
Mike, you have long known where I stand and how I feel about the socialist trend amongst the politicians of today. As a retired Navy Chief, and one of the earliest among the FBM Submarine Sailors, I was in the front line in our fight against socialism and I still stand in the face of it. But if you keep reading to page 113, it does indeed call for at least one health care professional. I oppose the bill, but it's important to get the facts right.

I have to ask do you think it can really be any worse than all of these same decisions which are now being made by insurance company doctors who are paid bonuses for "keeping down the costs" for the insurance companies and by insurance company executives making hundreds of thousands of dollars

I certainly understand that you are outraged, and concerned for our nation. Many of us are.
Politicians of both parties have become so expert, especially since the early 1970s, at flying the flag while harming the people or saying a prayer while promoting hate and violence. Few Americans seem to realize that wage earners in the U.S. have lost money, relative to inflation, every year (except perhaps one) since 1972. It now takes two full-time jobs to have a standard of living comparable to what a family had 35 years ago with one full-time job. It is no wonder our youth are increasingly unsupervised and out of control. We are being turned into a third world nation, governed by a super-rich elite.
Especially because of this long-term trend, I can't help but shed a tear when apparently decent, well-meaning people, fired by anger, shout out lies that distract the people from understanding what is really going on...right before their eyes.
Yes, you shout the catch phrases that get certain others shouting with you...but your essay on the health reform legislation being shaped...is hopelessly false. You should be ashamed for fostering ignorance when you have a chance to shed light.
Please take just a few issues and show us, exactly, where your concerns are verified.
Take these:
1) By what means and in what section of any current legislation is abortion going to paid for? I can tell your readers that the truth is exactly the opposite of what you wrote, but I think you should have a fair shot at explaining yourself. All of the legislation that has been drafted during this past year has PROHIBITED the use of federal funds for abortions. As an attorney, surely you know that this is merely the status quo...not a change at all. Federal funds have not been used for abortions for quite some time in our country.
2) Show us where any legislation now being considered would provide free care to undocumented (illegal) aliens? In point of fact, again JUST LIKE CURRENT LAW, federal funds MAY NOT be used to provide care to undocumented aliens. This is why counties tend to have very small free care pools, to help people who really need care but can't get through any federally supported program. Now, there is one exception: since the passage of Medicare, hospitals with emergency departments have been required by federal law to give truly emergency care to people without respect to their ability to pay. The purpose of this requirement was COMPASSION...so people bleeding to death on the street would not just be left there. NOTHING NEW is proposed in this area. And would you not say that it is both GOOD and AMERICAN that we care, just a little bit, about other people?
So many more untruths in your "letter" that I can tell you are immune to the truth...or perhaps not? Will you show your readers exactly where the two items mentioned above appear in legislation in the way you portray them? Where does ANY draft of ANY version say abortion and free care to undocumented aliens will be paid for with federal funds? Verily, I say to thee, if thou hadst actually read any of these documents you would either know better...or know that a serpent speaks for thee.
If you can deal with those two concrete truths, maybe you can learn to deal better with your imaginations about the impending doom of the republic.

Why weren't you writing this crap during the Bush years when the republicans were stomping the constitution into the ground and treating it like it didn't exist. Heatlhcare reform was intended to break the choke hold that the insurance industry has on the economy and control the fraud that waste billions every year. Instead of providing billions for CEO'S or share holders the money would be used to provided healthcare to the people who can't afford to pay the outrageous premiums that forces companies to move their businesses to other countries and keep small businesses from growing or new ones from opening. That's not socialism, it's enforcing the anti trust laws.
